Terms and Conditions of the Online Store

§ 1

Preliminary provisions

The online store astrojigs.com, available at the internet address astrojigs.com, is operated by Ryszard Wąsikiewicz conducting business under the name Laser Fryga Ryszard Wąsikiewicz, registered in the Central Register and Information on Economic Activity (CEIDG) maintained by the minister responsible for economy, Tax Identification Number (NIP) 888-273-53-85, National Business Registry Number (REGON) 301-956-323.

§ 2

Definitions

Consumer - a natural person entering into an agreement with the Seller within the Store, the subject of which is not directly related to their business or professional activity.

Seller - a natural person conducting business under the name Laser Fryga Ryszard Wąsikiewicz, registered in the Central Register and Information on Economic Activity (CEIDG) maintained by the minister responsible for economy, Tax Identification Number (NIP) 888-273-53-85, National Business Registry Number (REGON) 301-956-323.

Customer - any entity making purchases through the Store.

Entrepreneur - a natural person, a legal person, or an organizational unit without legal personality, which is granted legal capacity by a separate act, carrying out economic activity on their own behalf and using the Store.

Store - an online store operated by the Seller at the internet address https://astrojigs.com.

Distance contract - an agreement concluded with the Customer within an organized system of concluding contracts at a distance (within the Store), without the simultaneous physical presence of the parties, using exclusively one or more means of distance communication until the conclusion of the contract.

Terms and Conditions - these terms and conditions of the Store.

Order - the Customer's declaration of intent submitted using the Order Form and aimed directly at concluding a Sales Agreement for the Product or Products with the Seller.

Account - a customer account in the Store, where data provided by the Customer and information about Orders placed by them in the Store are stored.

Registration form - a form available in the Store enabling the creation of an Account.

Order form - an interactive form available in the Store enabling the placement of an Order, in particular by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.

Cart - a Store software element where Products selected for purchase are visible, and where it is possible to establish and modify Order data, in particular the quantity of products.

Product - a movable item/service available in the Store, which is the subject of a Sales Agreement between the Customer and the Seller.

Sales Agreement - a sales agreement for a Product concluded or to be concluded between the Customer and the Seller via the online Store. The Sales Agreement also includes - with regard to the characteristics of the Product - a service agreement and a work contract.

The Customer may contact the Seller using the addresses and phone numbers provided in this paragraph.

The Customer can communicate by phone with the Seller from 8:00 to 18:00.

§ 4

Technical requirements

To use the Store, including browsing the Store's assortment and placing orders for Products, the following are necessary:

an end device with access to the Internet and a web browser,

an active email account,

enabled cookie support.

§ 5

General information

To the fullest extent permitted by law, the Seller shall not be liable for disruptions, including interruptions in the functioning of the Store caused by force majeure, unauthorized actions of third parties, or incompatibility of the online Store with the Customer's technical infrastructure.

Browsing the Store's assortment does not require creating an Account. Placing orders by the Customer for Products available in the Store's assortment is possible either after creating an Account in accordance with the provisions of § 6 of the Terms and Conditions or by providing necessary personal and address data enabling the fulfillment of the Order without creating an Account.

Prices displayed in the Store are given in Polish zlotys and are gross prices (including VAT).

The final amount to be paid by the Customer includes the price for the Product and the cost of delivery (including fees for transportation, delivery, and postal services), which the Customer is informed about on the Store's pages during the ordering process, including at the moment of expressing the will to be bound by the Sales Agreement.

In the case of an Agreement covering a subscription or the provision of services for an indefinite period, the final (ultimate) price is the total price including all payments for the settlement period.

If the nature of the subject matter of the Agreement does not reasonably allow for the prior calculation of the final (ultimate) price, information about how the price will be calculated, as well as about fees for transportation, delivery, postal services, and other costs, will be provided in the Store in the Product description.

§ 6

Creating an Account in the Store

To create an Account in the Store, you need to fill out the Registration Form. The following data is required: email.

Creating an Account in the Store is free of charge.

Logging in to the Account is done by providing the login and password established in the Registration Form.

The Customer has the option to delete the Account at any time, without giving a reason and without incurring any fees for this purpose, by sending a relevant request to the Seller, in particular via email or in writing to the addresses provided in § 3.

§ 7

Ordering rules

To place an Order, you need to:

log in to the Store (optional);

select the Product that is the subject of the Order, and then click the "Add to Cart" button;

log in or use the option to place an Order without registration;

if the option to place an Order without registration is chosen - fill out the Order Form by entering the recipient's data and the delivery address for the Product, select the type of shipment (method of Product delivery), enter invoice details if they differ from the recipient's data,

click the "Order and Pay" button/click the "Order and Pay" button and confirm the order by clicking on the link sent in the email message,

choose one of the available payment methods and, depending on the payment method, pay for the order within the specified period, subject to § 8

point 4.

§ 8

Offered delivery and payment methods

The Customer can use the following methods of delivery or collection of the ordered Product:

Courier delivery,

Personal pickup available at the following location: ul. Krucza 5, 62-004 Kliny;

Electronic delivery (download);

Postal delivery.

The available methods of payment for the Order are:

Payment on delivery,

Payment by bank transfer to the Seller's bank account,

Electronic payments,

Payment by credit card.

Detailed information about the available delivery methods and acceptable payment methods can be found on the Store's website.

§ 9

Execution of the Sales Agreement

Conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer has placed an Order using the Order Form in the Store in accordance with § 7 of the Terms and Conditions.

After placing the Order, the Seller immediately confirms its receipt and at the same time accepts the Order for execution. Confirmation of receipt of the Order and its acceptance for execution is made by sending the Customer an appropriate e-mail message to the e-mail address provided during the Order placement, which contains at least the Seller's statement of receipt of the Order and its acceptance for execution and confirmation of the conclusion of the Sales Agreement. Upon receipt of the above-mentioned e-mail message by the Customer, a Sales Agreement is concluded between the Customer and the Seller.

If the Customer chooses:

payment by bank transfer, electronic payment or payment by credit card, the Customer is obliged to make the payment within 7 calendar days from the date of the Sales Agreement - otherwise, the order will be canceled;

payment on delivery, the order will be executed immediately after its confirmation.

If the Customer has chosen a method of payment other than payment on delivery, the Customer is obliged to make the payment within the time specified for payment. The beginning of the period for making the payment by the Customer is as follows:

if the Customer chooses the method of bank transfer, electronic payment or payment by credit card - from the date of the Sales Agreement;

if the Customer chooses payment on delivery - from the date of the Sales Agreement.

If the Customer is in default with payment, the Seller, after ineffective expiry of the additional deadline for payment, has the right to withdraw from the Sales Agreement in accordance with the provisions of the Civil Code.

§ 10

Promotions in the Store

The Seller may organize promotional campaigns in the Store, during which the terms of participation in the promotion, the duration of the promotion, the subject of the promotion, and the price conditions are individually regulated.

The terms of participation in the promotion, in particular the rules for granting discounts, are communicated by the Seller in the Store's pages organizing the promotion.

Promotional campaigns cannot be combined unless the terms of the promotion provide otherwise.

§ 11

The right to withdraw from the Agreement

A Consumer who has concluded a distance contract may withdraw from it within 14 calendar days without giving any reason and without incurring costs, except for the costs specified in § 11 point 8 and § 11 point 13 of the Terms and Conditions.

The period for withdrawing from the Agreement begins:

for a contract in which the Seller issues the Product, being obliged to transfer its ownership (e.g., Sales Agreement) - from taking possession of the Product by the Consumer or a third party designated by them other than the carrier, and in the case of a contract that:

includes many Products that are delivered separately, in batches, or in parts - from taking possession of the last Product, batch, or part,

consists in regular delivery of Products for a specified period - from taking possession of the first of the Products;

for other contracts - from the date of concluding the Agreement.

In the case of withdrawing from a distance contract, the Agreement is considered void.

The Consumer may withdraw from the Agreement by submitting to the Seller a statement of withdrawal from the Agreement. To meet the deadline to withdraw from the Agreement, it is sufficient for the Consumer to send a statement before its expiry.

The statement may be sent, for example:

in electronic form via email to the following address: sklep.grawer@gmail.com,

The Consumer may use the model withdrawal form, but it is not obligatory.

The Consumer may also submit a statement of withdrawal from the Agreement using the form, the template of which is attached as Annex 2 to the Act of 30 May 2014 on Consumer Rights, but it is not obligatory.

The period for withdrawing from the Agreement is considered met if the Consumer sends a statement before the expiry of that period.

Effects of withdrawal from the Agreement:

In the event of withdrawal from a distance contract, the Agreement is considered null and void.

In the event of withdrawal from the Agreement, the Seller returns to the Consumer all payments received from them, including the costs of delivering the Product (except for additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest usual delivery method offered by the Seller), immediately, and in any case no later than 14 calendar days from the date on which the Seller was informed about the Consumer's decision to exercise the right to withdraw from the Agreement.

The Seller reimburses the payment using the same method of payment as used by the Consumer, unless the Consumer has explicitly agreed to a different method of reimbursement, which does not involve any costs for them.

The Seller may withhold the reimbursement of the payment received from the Consumer until receipt of the Product back or until the Consumer provides proof of sending it back, depending on which event occurs first.

The Consumer should return the Product to the Seller's address given in the Terms and Conditions immediately, and in any case no later than 14 calendar days from the date on which they withdrew from the Agreement, unless the Seller suggested collecting the Product themselves.

The Consumer bears the direct cost of returning the Product, including returning the Product if, due to its nature, it cannot be returned by regular mail.

The Consumer is liable for reducing the value of the Product resulting from using it in a way that goes beyond what is necessary to establish the nature, characteristics, and functioning of the Product.

If the Product is returned incomplete, the Seller may charge the Consumer with the costs of restoring the Product to its original state, to the extent of the reduction in its value.

§ 12

Complaints about the Product

The basis and scope of the Seller's liability towards the Customer, if the Product sold has a physical or legal defect (warranty), are specified by generally applicable laws, in particular in the Civil Code (in particular, Articles 556-576 of the Civil Code).

The Seller is obliged to deliver goods free from defects.

Complaints may be submitted by the Customer, for example:

in writing to the address: ul. Krucza 5, 62-004 Kliny,

in electronic form via email to the following address: astrojigs@laserowo.com.pl

It is recommended that the complaint include a description of the defect, circumstances (including the date) of its occurrence, the data of the complaining party, and the request of the Customer in relation to the defect of the Product.

The Seller will address the complaint promptly, no later than within 14 days from the date of its submission. Lack of Seller's response within the period specified in the preceding sentence means that the Seller considered the complaint justified.

§ 13

Extra-judicial ways of dealing with complaints and redress

Detailed information on the possibility of the Customer being able

to use extrajudicial means of dealing with complaints and redress and the rules of access to these procedures are available at the Seller's premises or on the Seller's website.

§ 14

Personal data in the Online Store

The Seller is the administrator of personal data collected through the Online Store.

Personal data of the Customers collected by the administrator via the Online Store are collected for the purpose of performing the contract, and if the Customer agrees - also for marketing purposes.

The recipients of personal data of the Online Store Customers may be:

In the case of a Customer who uses the delivery method by courier, the Seller provides the Customer's collected personal data to the selected carrier or intermediary performing the shipment at the request of the Seller.

In the case of a Customer who uses the electronic payment method or payment by credit card in the Online Store, the Seller provides the Customer's collected personal data to the selected entity handling the above payments in the Online Store.

The Customer has the right to access their data and correct them.

Providing personal data is voluntary, but failure to provide the personal data indicated in the Terms and Conditions necessary to conclude the Sales Agreement results in the inability to conclude this agreement.

If the Customer agrees to receive commercial information by electronic means (i.e., subscribes to the newsletter), the Seller may send the Customer commercial information relevant to the Seller's business and offers of third parties.

Personal data provided by the Customer will be processed in accordance with the Act of 29 August 1997 on the protection of personal data and the Act of 18 July 2002 on the provision of electronic services.

The Customer has the right to access and correct their data.
